Open Question: What do you think about this?
couple weeks ago I sent her a message to her facebook wall asking her if she knew this girl at her school. we have never talked on facebook.

next day
-in the tone of seriousness,”is she like your girlfriend.”
-she had her leg crossed over moving toward me
some signs
-I turned off my cell phone and she was looking over at it while sitting next to me.
-plays with her hair. like running fingers through her hair or little strands.
-twice she has defended me when she thought somebody stole my answer.
-”don’t look at me”. in a flirty voice.
-one night she said my name like twice.
-once she said something random to me and started giggling after it.
-same night before I left me and her ran shoulders into each other shoulders kind of hard. we were on opposite sides of the room.
-other night she was talking to this girl beside me in hushed tones about this guy who apparently stood her up and dating in general. before hand she used another guy name referring to football.
-last night she complained that it was cold out. then she said it again louder then necessary.
-I tried making eye contact but when I did she twice looked away. she was playing with her hair before she looked away and after. the first time she came up to me I had plenty of eye contact.

she usually talks a lot and really fast. lately when she raises her hand to say something she can not finish up what she is saying. she most of the time uses somebodies name to cover it up or acts confused about what she was saying.

she is friendly and talkative to everyone. she flirts the most with me out of all the boys there. I have not seen her seriously touching anyone. my brother says that she seems flirty in the voice and likes getting attention from not just boys either.

Open Question: Can I Sue a Thief for Treble Damages?
About 11 months ago a jerk who stayed in my residential dorm stole my cell phone. I caught him red handed by having the phone company look up the #’s and accounts on my phones serial number and the dumb bastard had actually put his # and service on my phone. So I filled a police report and had his service turned off. I figured I’d let karma and the police catch up to him.

However I found out nearly four months later that the s.o.b. used a fake ID and turned another number on my phone. It turns out the company turned his service off but didn’t put a block on my phone so that it couldn’t be turned back on by the thief or anyone else. I took advantage of the situation and had the phone company give me his new number and called him and cursed him out. He wanted to talk sh*t at first until I told him about the police report. Then he gave me some sob story about being sorry and that he wanted to give the phone back. So we made arrangements for him to drop the phone off to me and I would drop the charges. But he kept making excusing why he couldn’t show up. Finally I left town to help family and have been gone for six months.

Now I am relocating back to Los Angeles (where all this happened) and once I’m settled I want to handle that unfinished business. I want to take the thief to court and sue him for the cost of the phone and its accessories but for treble damages. So what I want to know is can I sue him 11 months after the fact and can I sue for treble damages. If so how do I go about filling the law suit and suing for damages?
